Terms and Conditions
These terms and conditions, together with the Data Protection Policy, Website Terms of Use, Client Declaration Form and any other information brought to your attention before you submit your application, form the basis of your contract with Marbella United LLC, hereafter “the Company”, “we”, “us”. Please read these carefully as they set out our respective rights and obligations, and all services offered and accepted are subject to these terms and conditions. References to “you” and “your” include all persons named on the electronic visa waiver application and for whom the electronic visa waiver application is to be made the (“the User”). In these terms and conditions, unless the context otherwise requires, words in the singular shall include the plural and vice versa.
By instructing the Company to undertake services on your behalf, the User is deemed to have accepted these terms and conditions.
The services offered by the company consists of buy is not limited to the processing of electronic visa waiver applications and/or other documents for Users for the purposes of travel to the United Kingdom (“Offered Service”).
The Company is not an advisory service. The Company provides carefully collected information, which is, and must be taken as, only an interpretation of the information provided by the UK home office. The Company cannot be held liable for any omissions or errors in the information provided. You are strongly advised to check all information. Any costs incurred by following the information provided by the Company, without first checking its accuracy, are solely your responsibility. ‘Necessary Information’ means the information required from a User to allow the Company to submit an application for an electronic visa waiver to travel the United Kingdom, such information may include, but is not limited to, the User’s name, address, email, and any other information which the Company considers necessary for the purposes processing the User’s electronic visa waiver application. The Service Charge per electronic visa waiver application is required to cover the cost of providing the Offered Service and making an electronic visa waiver application on your behalf, payment of the Service Charge must be made by way of Credit or Debit card, as approved by the payment gateway “Gotap”. The Company will request payment of the Service Charge and the electronic visa waiver fee upon instruction by the User.
By supplying the necessary information, Users agree for the Company to make application/s for a travel electronic visa waiver application on the User’s behalf. Upon submitting the Application form with Necessary Information and making payment of the Service Charge, a contract will be formed between the User and the Company; such contract is subject to and governed by these Terms and Conditions. Once the contract has been created no refund is available, regardless of whether the electronic visa waiver application is successful/approved or not.
The processing of an electronic visa waiver can take up to 24 hours or more from receipt of the electronic visa waiver application as required by the government of UK.
The Company will send the approved electronic visa waiver applications by email to the User, the User’s responsibility to check the inbox and the junk mail box for received emails/notifications from the Company.
Liability and Limitations
By instructing the company for the provision of the Offered Service, the User accepts all requirements, restrictions and limitations of liability set out in all documentation forming the contract between the parties. We do not accept any responsibility if you cannot travel, or incur any other loss because the User have not complied with any passport, visa, electronic visa waiver, immigration requirements or health formalities.
You agree to reimburse us in relation to any fines or other losses which we incur as a result of your failure to comply with any passport, visa, electronic visa waiver, immigration requirements or health formalities.
The Company cannot be held liable for any decision made by the UK government with regards to a User’s electronic visa waiver application, and the User accepts that the Company has no involvement in the decision made by the UK government. The Company cannot accept any responsibility for or be held liable for the actions of any delaying or not issuing the electronic visa waiver or any other failure or error on the part of the UK government for any reason whatsoever nor can the Company be held liable for any expenses or delays incurred as a result.
The Company cannot be held liable for any of the following: a) incomplete applications forms; b) incorrectly or falsely completed applications forms; c) inaccurate or incomplete supporting documentation. The User is under an obligation to provide correct and accurate information to the Company and the Company cannot be held liable for any failure by the User to do so.
You are responsible for making yourself aware of all official advices and warnings in regard to the safety of the countries and areas in which you will be travelling and to make your decisions accordingly.
The Company cannot be held liable for any delay or failure of a User failure of receiving emails and/or notifications from the Company for whatsoever reason.
Should the Company accept liability for the failure to obtain a requested electronic visa waiver, or return a requested visa to the User in a timely manner, the user’s sole and exclusive remedy against the Company for damages is the return of any Service Charge actually paid by the User to the Company, minus any government fees or third party service charges. Please note, we cannot accept any liability for any damage, loss or expense or other sum(s) of any description which on the basis of the information given to us by you concerning your electronic visa waiver application prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you (consequential losses); or (b) any business losses. We do not exclude liability for any cause of action, loss or damage prohibited by Kuwait law.
Website
The User’s use of the Website and or the Offered Service is on the strict understanding that the Website and or the Offered Service is not engaged in rendering advice and should not be relied upon when making any related travel or other decision. The information contained within the Website and or the Offered Service is provided without warranties expressed or implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Website and or the Offered Service. The Company does not guarantee uninterrupted availability of the Website and or the Offered Service nor, that any representation or statement contained on the Website will be error free.
Complaints
We will make our best endeavors to ensure your electronic visa waiver application goes smoothly. However, in the rare event that you are not happy with the service you have received and wish to make a complaint, we request that you notify the Company of your complaint by email as soon as possible to support@ukevw.com. Complaints should be marked for the attention of: Customer Service Manager at Marbella United LLC.
Data Protection Act 1998
Marbella United LLC ("We") are committed to protecting and respecting your privacy.
This policy together with our terms and conditions sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
For the purpose of the Data Protection Act 1998 (the Act), the data controller is Marbella United LLC.
Marbella United LLC will collect personal information from the application form which you submit to us upon instruction; passport photocopies and any other documentation provided to us for the purposes of your electronic visa waiver application. This will include but is not limited to the User's name, contact details such as your address, phone and email and holiday destination.
Personal information may also be gathered from when you write email us to make an enquiry.
Marbella United LLC uses your personal information to submit an electronic visa waiver application on your behalf. For the purpose of providing you with our services, we will disclose the information to a third party which is UK government.
In order for you to travel overseas, it may be mandatory (as requested by government authorities) to disclose your information for immigration, security and anti-terrorism purposes, or any other purposes which they determine appropriate. Even if not mandatory, we may exercise our discretion to assist where appropriate.
Marbella United LLC may also use information held about you in the following ways:
• To ensure that content from our site is presented in the most effective manner for you and for your computer;
• To provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes;
• To carry out our obligations arising from any contracts entered into between you and us;
• To notify you about changes to our service.
Marbella United LLC does not sell or pass on data to any third parties but we may use your data on behalf of a third party.
Marbella United LLC may also collect details of your visits to our site including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.
We may also disclose information to organizations who act as "data processors" on our behalf, or to other organizations who perform business functions on our behalf. These functions include administration, providing services (and contacting you where necessary), customer care, business management and operation, re-organization/structuring/sale of our business (or our group companies), risk assessment, payment gateway, security and crime prevention/detection, research and analysis, marketing, monitoring, measuring and assessing customer purchasing preferences and trends, dispute resolution, credit checking and debt collection.
Due to privacy laws, Marbella United LLC is unable to discuss your personal details and/or your electronic visa waiver applications with any third party enquiring on your behalf (including family) unless you provide your consent authorizing us to do so.
We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users' browsing actions and patterns, and does not identify any individual.
For the same reason, we may obtain information about your general internet usage by using a cookie file which is stored on the hard drive of your computer. Cookies contain information that is transferred to your computer's hard drive. They help us to improve our site and to deliver a better and more personalized service. They enable us:
• To estimate our audience size and usage pattern;
• To store information about your preferences, and so allow us to customize our site according to your individual interests;
• To speed up your searches;
• To recognize you when you return to our site.
You may refuse to accept cookies by activating the setting on your browser which allows you to refuse the setting of cookies. However, if you select this setting you may be unable to access certain parts of our site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you log on to our site.
By submitting your personal data, you agree to the below outlined transfer, storage or processing of said data. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.
All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted. Where We have given you (or where you have chosen) a password or PIN codes which enables you to access certain parts of our site, you are responsible for keeping this password or PIN code confidential. We ask you not to share a it with anyone.
We have taken all reasonable steps to have appropriate security measures in place to protect your information. The transmission of information via the internet is never completely secure. We exclude our liability for personal data lost in transmission to the website.
We may pass your details to other parties who offer goods or services which we feel may interest you. If do not wish to have your details passed on in this way, you may ask us in writing not to do so.

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.
Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by e-mail. Questions, comments and requests regarding this privacy policy are welcomed and should be addressed to support@ukevw.com.
Severance
If any (singular or plural) provision of these Terms and Conditions is held to be invalid or unenforceable, such provision(s) shall be struck out and the remaining provisions shall remain in force. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
Law and Jurisdiction
It is agreed that any dispute, claim or other matter which may arise in relation to your electronic visa waiver application and/or Offered Service will be governed by Kuwait law and the parties agree to submit to the exclusive jurisdiction of the Courts of Kuwait.
